Cookie Policy

This cookie policy (the “Cookie Policy”) describes the different types of cookies and similar technologies that may be applied by Smarketing Cloud on the third party customer websites or mobile applications and the online, mobile and connected TV properties (each a “Digital Media Property”) that Smarketing Cloud supports.

We use the Smarketing Cloud Platform to help advertisers serve video and rich media advertisements to visitors (“Users”) to the Digital Media Properties. When we refer to the “Smarketing Cloud Platform” we are referring to our hosted technology platform that we use to serve advertisements through the Digital Media Properties. In this Cookie Policy, we use the term “Analytics Information” to mean any information regarding, or collected during, the delivery of an advertisement to a User’s device and subsequent User engagement with that advertisement. In some cases, it may refer to additional information collected during a User’s interaction with a web page, mobile application or other service.

We collect, use, deploy and share Analytics Information, using various tracking technologies, including cookies.

1. What is a Cookie?

A cookie is a small text file containing a string of characters that is placed by an Internet server on your device. Cookies can be either session cookies or persistent cookies, and Smarketing Cloud serves both types. A session cookie is deleted from your device automatically when you close your browser. A persistent cookie remains on your device for a specified period of time and may be accessed by Smarketing Cloud on subsequent visits by you to Digital Media Properties operated by our customers.

Cookies are useful because they help us ensure that the video advertisements you see online when you visit our customers’ Digital Media Properties are more relevant to you and your interests.

Cookies do not typically identify you as an individual, just the device you are using. For further information on cookies, including how to see what cookies have been set on your device and how to manage and delete them, visit http://www.allaboutcookies.org.

The specific types of first and third party cookies served through the Smarketing Cloud Platform and the purposes they perform are described in the chart below.

3. Other Technologies

Cookies are not the only way we recognize or track visitors to the YuMe Platform. We may also use other, similar technologies from time to time to store and retrieve Analytics Information from a User’s device, including:

Pixel Tags or Web Beacons. A tracking pixel (also known as a “web beacon” or “clear gif”) is a tiny transparent graphics file (usually 1 pixel x 1 pixel) that is placed on a web page and, in combination with a cookie, allows for the collection of information regarding the use of the web page that contains the tracking pixel. We use tracking pixels to tell when an advertisement has been clicked on or otherwise interacted with, and use that information to judge which advertisements are more appealing to Users. In some cases, we use third party service providers to help us collect and analyze this information.

Mobile Device Identifiers and SDKs. A mobile SDK is the mobile app version of a pixel tag or web beacon (see “Pixel Tags or Web Beacons” above). An SDK is a bit of computer code that app developers can include in their apps to enable ads to be shown, data to be collected, and related services to be implemented. We use this technology to deliver certain advertising through mobile applications and browsers based on Analytics Information associated with your mobile device. If you’d like to opt-out from having ads tailored to you in this way on your mobile device, please follow the instructions in the “Your Choices” section of this Cookie Policy below.

4. Third-Party Cookies

We also receive Analytics Information regarding User demographics and preferences from Digital Media Property Owners that choose to provide it to us, as well as from trusted third-party analytics companies like Neilson and ComScore, which collect and make available such Analytics Information for advertisement-serving purposes by placing cookies or web beacons on your device. Please review the “Your Choices” section of this Cookie Policy below for instructions on how to opt-out of having Analytics Information collected for purposes of targeted advertising.

Smarketing Cloud seeks to work with Digital Media Property Owners and other third parties that comply with all applicable privacy laws with respect to activities that relate to their relationship with us, but ultimately does not have control over such third parties and the cookies they place, so we suggest that you review their respective privacy policies to help you understand what data these organizations hold about you and what they do with it.

5. Your Choices

How to control which cookies are set

You have the right to decide whether to accept or reject cookies. There are a number of ways you can manage what cookies are set on you devices.

You can manage what cookies are set on your browser by doing one of the following:

The first time you visit a Digital Media Property you will be given an opportunity to consent to the use of cookies by YuMe. You can also exercise your cookie preferences by clicking on the appropriate opt-out links provided in the cookie table above.

In addition, most web browsers are initially set up to accept cookies, but you can change your web browser settings to cause your browser to refuse cookies or to indicate when a cookie is being set. You can remove and/or disable cookies by following directions provided in your Internet web browser’s “help” file or menu. Please be aware, however, that in addition to preventing functioning of the YuMe Platform, disabling cookies through your browser may also cause some aspects of a Digital Media Property not to function properly.

Disabling most targeting or advertising cookies

Browser-Based Data Collection

You may opt out of the use of sMarketing Cloud cookies for purposes of delivering more relevant advertising on your browser by doing any one of the following:

Clicking on the “Opt-Out” button at the top of this Cookie Policy. Please note, that if you disable all cookies via your browser settings (see below) and then change the browser on the device from which you opted out of the targeted advertising, or use a different device, you will need to opt out again from receiving cookies.

Visiting opt-outs of standard bodies. YuMe is a member of the Network Advertising Initiative (“NAI”) and the Digital Advertising Alliance (“DAA”) and the Internet Advertising Bureau (“IAB”) and adheres to each organization’s principles (the NAI Codes of Conduct, the DAA Self-Regulatory Program for Online Behavioral Advertising and the IAB’s Self-Regulatory Principles for Online Behavioral Advertising, respectively). You can opt-out of Smarketing Cloud targeted advertising based on data collected via your browser by using (a) the NAI’s opt-out tool, which can be found here; or (b) the DAA’s opt-out tool, which can be found here.

In addition, most advertising networks offer you a way to opt out of targeted advertising. If you would like to find out more information, please visit http://www.aboutads.info/choices or http://www.youronlinechoices.com.

When you opt out, we will stop serving you targeted ads based on the data collected via your browser.

We will subsequently place a piece of data in your browser’s cookie that tells us that you have opted out of sMarketing Cloud; it does not contain any data about you except for the fact that you have opted out. We need this cookie in place so that we know not to collect information about your interests and serve you interest-based targeted ads in the future.

Mobile Application-Based Data Collection

You may also opt out of sMarketing Cloud’s mobile interest-based advertising by following your mobile device maker’s most current published instructions, such as the examples below (current as of the date of this version of our Cookie Policy). 

iOS

Devices with iOS 6 and above use Apple’s Advertising Identifier. To learn more about limiting ad tracking using this identifier, visit the Settings menu on your device as follows:

iOS 7 or higher – Choose Settings > Privacy > Advertising

iOS 6 – Choose Settings > General > About > Advertising 

Android

If you have an Android device and would like to opt-out of mobile interest-based or “cross-app” advertising, you may do so as follows:

  1. Open the Google Settings app on your device.
  2. Select Ads.
  3. Opt out of interest-based ads.

Our systems are designed to respect these choices transmitted by your Android device.

When you opt out, we will stop serving you targeted ads based on the data collected via your mobile applications.

Please note that opting out of either Browser-Based or Mobile Application-Based Data Collection does not mean you will not see ads online from sMarketing Cloud or other digital advertising companies, but only that sMarketing Cloud’s will not tailor ads based on your interests. 

Do Not Track Disclosure

Do Not Track (“DNT”) is a privacy preference that Users may set in certain web browsers. DNT is intended to allow Users another method of informing websites and services that they do not want certain information about their website visits collected over time and across websites.

Because the effect of DNT signals remains unclear, and there continues to be no consistent industry understanding of how to respond to such a signal, we do not alter our privacy practices when we detect a DNT signal from your browser. Rather, we provide or respect the other consumer choice options set forth in this Section. 

6. Updates to this Cookie Policy

We may update this Cookie Policy from time to time, in order to reflect, for example, changes to the cookies we use or for other operational, legal or regulatory reasons. When we do, we will also revise the effective date at the beginning of this Cookie Policy. We encourage you to periodically review this Cookie Policy to stay informed about how we use cookies and similar technologies.
